WILMERHALE

Comment: The client list of this highly recommended antitrust practice is still defined by the stable and excellent contacts to well-known companies. Deutsche Telekom, Tui and Deutsche Bahn have all trusted this highly experienced team for years. In antitrust damages suits, where WH has long been acquiring expertise, it is now an old hand, but it also has a clear affinity for litigation cases. This made it all the more crucial to fill in a gap by bringing in Dr. Vanessa Wettner from Hengeler as a partner. The teams in Berlin and Frankfurt have recently been involved in more international merger controls, e.g. for International Paper and Baker Hughes – cases where the close connections to the US practice really paid off.
Strengths: Closely integrated antitrust and litigation practices with experienced partners. Tried and tested cooperation with the US practice.
Development potential: Like other US firms, WH has to measure its German practice against the US practice’s earnings. For this reason it is unlikely that the practice will immediately bounce back from the loss of two partners (Dr. Jan Heithecker is no longer active as a lawyer and Dr. Christofer Eggers left for Squire Patton Boggs). So it will be important to keep the team of experienced associates stable and promote them more intensively in the market.
Recommended: Ulrich Quack (“we are always happy with his work”, client), Prof. Dr. Hans-Georg Kamann (“constructive and fast, bills are transparent and moderate”, client), Dr. Stefan Ohlhoff, Dr. Peter Gey (“is involved in many important cases”, competitor).
Practice: All-round practice with German and European merger controls as well as abuse and cartel cases. Strong connections to regulated industries such as ?energy (esp. Berlin), telecoms and ?state aid. (3 equity partners, 2 salary partners, 9 associates)
Clients: ?? Deutsche Lufthansa, incl. damages suit from Barnsdale (incl. Deutsche Bahn) and complaint against fine in the air freight cartel; Deutsche Telekom on accusations of abusive price-setting for antenna rental and sale of Strato; Katjes Fassin on damages suit against the sugar cartel, also Krombacher and Schweppes Germany; Coop as a third party in the Edeka/Tengelmann merger; Deutsche Bahn on damages claims against the rail cartel.
